Objective

The aim of the course is to establish basis for the students expertise in European law. The history and practice of the development is related to the general legal theoretical and cultural context of the European integration. There is a detailed analysis of the effects of the European legal tradition and system on the legal reasoning, argumentation, adjudication and political discussion in general.
After the course the student knows, understands and has skills particularly in the following fields:
- The basic features of modern European legal tradition (legal ideology, values, effects, the relationship between international, European and national law),
- The political and legal developments of the European integration,
- The basic principles, concepts and objectives of the European union system,
- The main legislation and practice of the European union court,
- Ability to read legislation and court cases in their systematic context,
- Understands the dynamics between various European and international legal orders,
- Meaning of the European law for legal reasoning and practice,
- Effective use of European law,
- Basic ability to conduct legal research in this field and take part of the European union legal discourse .

Execution methods

Lectures: Lecture hall, remote connection, Zoom videos, no lecture or pre-reading notes to be delivered to the teacher.

Exams as Moodle exams at the times agreed upon during the lecture. 4 attempts every month after the lectures.

Moodle and Zoom are used as platforms of the course.

Content

Basic knowledge of the European political and legal integration, the structure of the system and the substantive law of the European Union.
1. Legal-historical developments of the European integration,
3. European legal tradition (philosophical, social scientific, political, juridical) ,
2. The constitutional developments,
3. The Treaties and the system of competencies,
4. Derived legislation and its systematic analysis with examples,
5. The union court system and legal procedures,
6. Constitutional, internal market and other case law (examples from all fields of competences).

During the lectures original legal texts (legislation, cases) and scholarly articles are used when analyzing these various topics.

- Articles, cases and official documents dealt with during the lectures (in Moodle),




- The book: Muir, Elise, An Introduction to the EU legal order, 2023 (available electronically in LUC database. Some books in the library).
